1. Introduction

These Terms of Service (“Terms”) govern your use of the Agency Coaching website at agency-coaching.com (“Website”) and any coaching services provided by Phillip (PJ) Norman trading as Agency Coaching (“we”, “us”, or “our”).

By accessing our Website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.

These Terms should be read alongside our Privacy & Cookie Policy.

3. Using Our Website

3.1 Eligibility

You must be at least 18 years old to use our Website or engage our services. By using the Website or purchasing a coaching package, you confirm that you meet this requirement.

3.2 Acceptable Use

You agree to use our Website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Website in any way that violates applicable laws or regulations
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Attempt to gain unauthorised access to any part of the Website or its related systems
  • Introduce viruses, malware, or other harmful material
  • Reproduce, duplicate, copy, or exploit any part of the Website for commercial purposes without our written permission

3.3 Website Availability

We aim to keep the Website available at all times but do not guarantee uninterrupted access. We may suspend or withdraw the Website at any time without notice for operational, maintenance, or security reasons.


4. Coaching Services

4.1 Nature of Coaching

Coaching is a professional relationship focused on personal and professional development. It is distinct from therapy, counselling, mentoring, or consulting. We do not provide medical, legal, financial, or psychological advice.

If you are experiencing a mental health crisis or require therapeutic support, we strongly encourage you to seek assistance from a qualified mental health professional.

4.2 Introductory Call

We offer a complimentary 30-minute introductory call via Zoom. This session is an opportunity to explore whether we are a good fit to work together and carries no obligation to purchase any coaching package. We reserve the right to decline to proceed with a coaching relationship following the introductory call.

4.3 Coaching Packages

We currently offer the following coaching packages:

  • Goal-Setter Package — 6 x 1-hour sessions
  • Journey Package — 10 x 1-hour sessions
  • Check-in Package — 3 x 1-hour sessions (available to clients who have completed a Goal-Setter or Journey package)

Sessions are delivered remotely via Zoom or in person, subject to agreement at the time of booking. Scheduling is flexible and agreed between coach and client.

4.4 Your Responsibilities as a Client

To get the most from coaching, you agree to:

  • Attend sessions punctually and prepared to engage
  • Give reasonable notice if you need to reschedule or cancel (see Section 5)
  • Be honest and open in your engagement with the coaching process
  • Take responsibility for your own decisions and actions arising from coaching

Coaching outcomes depend on your active participation. We cannot guarantee specific results.

4.5 Confidentiality

We treat all information shared during coaching sessions as strictly confidential. We will not disclose your personal information to any third party without your consent, except where required by law or where there is a risk of serious harm to you or others.

You agree to treat any information shared by us during the coaching relationship — including materials, frameworks, or approaches — as confidential and not to share or reproduce them without our written permission.


5. Cancellations and Rescheduling

5.1 Client Cancellations

We ask for at least 48 hours’ notice if you need to cancel or reschedule a session. Sessions cancelled with less than 48 hours’ notice may be forfeited without a refund or replacement, at our discretion.

5.2 Coach Cancellations

If we need to cancel or reschedule a session, we will give you as much notice as possible and offer an alternative time. In the unlikely event that we are unable to fulfil a session and no suitable alternative can be agreed, we will refund the pro-rata value of that session.


6. Payments

6.1 Pricing

Coaching package fees are displayed on our Website. Prices may be shown in multiple currencies (AUD, USD, EUR, GBP) for convenience. The currency charged will be confirmed at checkout. All prices are inclusive of any applicable taxes unless otherwise stated.

6.2 Payment

Full payment is required at the time of booking unless otherwise agreed in writing. Payments are processed securely via our payment provider. We do not store your full payment card details.

6.3 Refunds

We want you to feel confident booking with us. If you have concerns about a coaching package before your first session, please contact us and we will do our best to resolve them.

Refunds after sessions have commenced will be considered on a case-by-case basis. We will assess requests fairly, taking into account the number of sessions already delivered and the circumstances involved.


7. Intellectual Property

7.1 Our Content

All content on the Website — including text, images, journal articles, client stories, coaching frameworks, and branding — is the intellectual property of Agency Coaching or its licensors. You may not reproduce, distribute, or create derivative works from any of this content without our prior written permission.

You may share links to our Website content and quote brief excerpts for non-commercial purposes, provided you attribute the source clearly.

7.2 Your Content

If you submit content to us (for example, via our contact form or by contributing a client story), you grant us a non-exclusive, royalty-free licence to use that content in connection with our services and Website, unless otherwise agreed.


8. Testimonials and Stories

Client testimonials and stories featured on our Website are shared with the explicit consent of the individuals involved. Names and identifying details may be adjusted at the client’s request.

If you have provided a testimonial or contributed to a story and wish to have it amended or removed, please contact us at hello@agency-coaching.com.


9. Third-Party Services

Our Website and services make use of third-party platforms including Zoom (for session delivery), payment processors (for transactions), and social media platforms (LinkedIn and Instagram). Your use of these platforms is subject to their own terms and privacy policies. We are not responsible for the practices of any third-party services.


10. Disclaimer of Warranties

Our Website and services are provided on an “as is” basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding:

  • The accuracy, completeness, or suitability of information on the Website
  • The results you may achieve through coaching
  • The uninterrupted or error-free operation of the Website

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.


11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential losses arising from your use of the Website or our services, including but not limited to loss of income, loss of business, or loss of data.

Our total liability to you in connection with any coaching engagement shall not exceed the total fees paid by you for the relevant package.


12. Governing Law and Jurisdiction

12.1 UK Clients

If you are based in the United Kingdom, these Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

12.2 Australian Clients

If you are based in Australia, these Terms are also subject to applicable Australian consumer law, including the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010. Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you have under the ACL that cannot lawfully be excluded.

12.3 Other Jurisdictions

If you are accessing our services from outside the UK or Australia, you do so at your own initiative and are responsible for compliance with local laws.


13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will be revised whenever we make changes. Continued use of our Website or services following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
